FREAK SITES™ AFFILIATE TERMS AND CONDITIONS

These Affiliate Terms and Conditions govern participation in the separate affiliate programs operated by Freak Sites, Inc. through websites within the Freak Sites™ network.

Freak Sites, Inc. may be referred to as:

  • “Freak Sites”;
  • “FS”;
  • “we”;
  • “us”;
  • or “our.”

Each website within the Freak Sites network may be referred to as an “Island.”
By applying for, accessing, or participating in an Island Affiliate Program, you agree to these terms.

If you do not agree, do not participate.

1. SEPARATE AFFILIATE PROGRAMS

Each participating Freak Sites Island operates its own separate Affiliate Program.
Joining the Affiliate Program on one Island does not automatically enroll you in the Affiliate Program on another Island.

To promote more than one Freak Sites Island as an affiliate, you must separately apply for and be accepted into the Affiliate Program offered by each Island.

Each Island may maintain its own:

  • affiliate account;
  • Affiliate Dashboard;
  • referral links;
  • tracking records;
  • customer relationships;
  • commission records;
  • payout balance;
  • and promotional materials.

Unless Freak Sites clearly states otherwise:

  • affiliate accounts do not automatically transfer between Islands;
  • referral links work only for the Island that issued them;
  • referrals do not automatically transfer between Islands;
  • linked customers do not automatically transfer between Islands;
  • affiliate tiers do not automatically transfer between Islands;
  • purchases on one Island do not generate commissions through another Island;
  • and commission balances are maintained separately.

All participating Island Affiliate Programs follow these common Affiliate Terms unless a specific Island publishes an additional or different written term.

2. FREE TO JOIN

Each Freak Sites Affiliate Program is free to join.

You are not required to:

  • purchase a listing or advertisement;
  • purchase inventory;
  • pay a membership fee;
  • maintain a recurring order;
  • or meet a personal purchasing quota.

Purchasing a Freak Sites listing, advertisement, or service is optional and does not guarantee commissions or income.
Purchasing a listing or creating an account does not automatically make you an affiliate.

To receive an affiliate link, track referrals, build an affiliate network, or earn commissions on an Island, you must separately apply for and be accepted into that Island’s Affiliate Program.

3. APPLICATION AND PARTICIPATION

You must provide accurate information when applying.

Freak Sites may approve, reject, suspend, or terminate an affiliate account when reasonably necessary to protect the program, its users, an Island, or the Freak Sites brand.

Approval on one Island does not guarantee approval on another Island.

You may not create multiple, duplicate, or false accounts to:

  • manipulate tracking;
  • obtain duplicate commissions;
  • evade restrictions;
  • conceal your identity;
  • or avoid a prior suspension or termination.

You must be legally capable of entering into this agreement.

If you participate for a business or organization, you confirm that you have authority to act for it.

4. INDEPENDENT AFFILIATE

You participate as an independent affiliate—not as an employee, partner, franchisee, representative, or legal agent of Freak Sites or any Island.

You may not:

  • enter into contracts for Freak Sites;
  • make promises on behalf of Freak Sites;
  • claim that you work for Freak Sites or an Island;
  • bind Freak Sites to an obligation;
  • or represent that you have authority to approve listings, advertisements, commissions, refunds, or purchases.

You are responsible for your own expenses, equipment, advertising costs, taxes, business decisions, records, and legal compliance.

5. COMMISSION STRUCTURE

Unless an Island clearly publishes a different commission schedule, the standard Freak Sites commission structure may distribute up to 55 percent of a qualifying purchase through one connected five-tier affiliate path:

  • Direct Referral: 20%
  • Tier One: 15%
  • Tier Two: 10%
  • Tier Three: 5%
  • Tier Four: 5%

These percentages do not mean every purchase will generate five commission payments.

A commission is paid at a particular tier only when:

  • an eligible affiliate occupies that tier;
  • the affiliate has joined the applicable Island Affiliate Program;
  • the affiliate is active and in good standing;
  • the transaction is properly tracked and attributed;
  • the product qualifies;
  • payment is successfully completed;
  • and the transaction satisfies these terms.

You are not paid merely because someone registers, creates an account, or joins an Affiliate Program.

Commissions are earned only from qualifying purchases.

6. QUALIFYING PURCHASES

Commission-eligible purchases may include:

  • first listings or advertisements;
  • additional listings or advertisements;
  • listing packages;
  • StoryDrive™ packages;
  • Video Features;
  • visibility services;
  • upgrades;
  • and other products identified as commission-eligible by the applicable Island.

Prices and eligible products may vary between Islands.

A transaction generally qualifies only when:

  • the purchase occurs on the applicable Island;
  • the purchase is properly tracked or attributed to an affiliate on that Island;
  • payment is completed;
  • the transaction is legitimate;
  • the product is eligible;
  • the affiliate complied with these terms;
  • and Freak Sites approves the commission.

Commissions may be rejected or reversed for:

  • failed payments;
  • duplicate transactions;
  • refunds;
  • chargebacks;
  • canceled orders;
  • fraud;
  • test purchases;
  • false accounts;
  • tracking manipulation;
  • prohibited promotional methods;
  • or other ineligible transactions.

7. LIFETIME CUSTOMER COMMISSIONS

An Island may link an eligible customer to the affiliate who originally referred that customer on that Island.

When a customer is successfully linked, the affiliate may continue earning commissions on that customer’s future qualifying purchases on the same Island, even after the original referral cookie expires or the customer does not use the affiliate link again.

Future qualifying purchases may include additional listings, advertising, StoryDrive™, Video Features, upgrades, and other eligible products.

“Lifetime commission” means continued attribution for a properly linked customer on the applicable Island.

It does not mean:

  • the customer is guaranteed to purchase again;
  • every future purchase will qualify;
  • the affiliate owns the customer;
  • the customer is automatically linked across every Freak Sites Island;
  • the customer link can never be corrected;
  • commission rates can never change;
  • or the Affiliate Program must operate forever.

Future commissions require:

  • an active affiliate account in good standing on the applicable Island;
  • a properly linked customer on that Island;
  • a qualifying product;
  • successful payment;
  • and compliance with current program terms.

Freak Sites may correct, link, unlink, or reassign a customer when reasonably necessary because of:

  • tracking errors;
  • duplicate customer records;
  • incorrect email or account information;
  • conflicting attribution;
  • fraud;
  • manipulation;
  • technical limitations;
  • customer-account changes;
  • or legal and privacy requirements.

Unless Freak Sites clearly states otherwise, a customer linked to you on one Island is not automatically linked to you on another Island.

8. TRACKING AND ATTRIBUTION

Affiliates receive approved links or other tracking tools from each Island Affiliate Program they join.

A referral cookie may remain active for up to 120 days, subject to technical limitations and current program settings.

Affiliate tracking may use:

  • referral links;
  • cookies;
  • customer accounts;
  • customer email addresses or identifiers;
  • transaction records;
  • approved affiliate codes;
  • IP addresses;
  • and other available attribution information.

Tracking is not guaranteed.

Tracking may fail or be affected by:

  • deleted or blocked cookies;
  • browser privacy settings;
  • ad blockers;
  • incorrect links;
  • use of another device or browser;
  • changed email addresses;
  • duplicate accounts;
  • third-party systems;
  • software errors;
  • or network interruptions.

Freak Sites’ system and transaction records will normally control attribution.

9. ATTRIBUTION REVIEW REQUESTS

If you believe a qualifying customer or purchase was not properly attributed to you, you may request a review.

Provide as much relevant information as possible, including:

  • the Island involved;
  • your affiliate account information;
  • the customer’s name or identifying information known to you;
  • the approximate referral date;
  • the approximate purchase date;
  • the product purchased;
  • the affiliate link used;
  • and any screenshots, messages, or other supporting evidence.

Do not submit complete payment-card information, passwords, Social Security numbers, or unnecessary sensitive information.

A review request does not guarantee that a customer or commission will be assigned to you.

Freak Sites may:

  • approve or deny the request;
  • request additional information;
  • correct a referral;
  • manually link a customer;
  • reassign a transaction;
  • leave the existing attribution unchanged;
  • or determine that the available evidence is insufficient.

Freak Sites is not required to change attribution when:

  • records are unavailable;
  • evidence conflicts;
  • another affiliate has a stronger qualifying claim;
  • the transaction occurred on another Island;
  • the purchase occurred before a valid referral;
  • or a change would require speculation.

10. PENDING COMMISSIONS, REFUNDS, AND REVERSALS

Commissions may initially appear as pending while Freak Sites confirms:

  • payment;
  • eligibility;
  • attribution;
  • absence of fraud;
  • absence of a refund or chargeback;
  • and affiliate compliance.

A pending commission is not yet payable.

If a transaction is refunded, canceled, disputed, reversed, charged back, fraudulent, or otherwise invalidated, the related commission may be:

  • rejected;
  • reduced;
  • reversed;
  • deducted from an unpaid balance;
  • or deducted from future commissions.

Freak Sites may correct duplicate, inaccurate, improperly attributed, or technically generated commissions.

11. PAYOUTS

Unless an Island clearly publishes a different payout rule, the current minimum payout is:

$25 USD

Payouts are currently scheduled every other Friday through PayPal or another payment method approved by Freak Sites.

Because each Island operates a separate Affiliate Program, commission balances and payouts may be calculated separately for each Island.

A balance on one Island may not be combined with a balance on another Island unless Freak Sites expressly permits it.

You are responsible for providing accurate payment information and maintaining an eligible payment account.

Payouts may be delayed for reasons including:

  • holidays;
  • account review;
  • identity verification;
  • tax-document requirements;
  • fraud review;
  • incorrect payment information;
  • processor restrictions;
  • or technical problems.

You are responsible for your own taxes.

Freak Sites may request tax information required to process or report payments.

12. REQUIRED AFFILIATE DISCLOSURE

Whenever you promote Freak Sites or an Island using an affiliate link, recommendation, review, video, social-media post, email, article, paid advertisement, or other communication, you must clearly disclose that you may earn a commission.

The disclosure should be easy to notice and placed close to the affiliate link or recommendation.

Examples include:

“I am a Freak Sites affiliate and may earn a commission if you purchase through my link.”

“Affiliate link: I may earn a commission from qualifying purchases.”

“I am a Cars Freak affiliate and may earn a commission from this link.”

Do not hide the disclosure in a footer, profile page, long list of hashtags, or separate legal page.

13. TRUTHFUL PROMOTION AND EARNINGS CLAIMS

You must describe Freak Sites, each Island, its products, and its Affiliate Program truthfully and accurately.

You may not claim or imply that:

  • income is guaranteed;
  • commissions are automatic;
  • everyone earns money;
  • all five tiers will develop;
  • lifetime customer links can never change;
  • every referral will be tracked;
  • a listing or advertisement is guaranteed to receive views;
  • an advertiser is guaranteed to receive leads, customers, sales, or income;
  • or an earnings example is typical or promised.

You may use official Freak Sites earnings illustrations only when you reproduce them accurately and keep the assumptions and disclaimers with them.

You may not create your own earnings projections using a Freak Sites or Island name, products, commission structure, or branding without written permission.

You may describe your genuine personal experience, but you may not fabricate results, alter payment screenshots, use fake testimonials, or suggest that your result is typical without support.

Freak Sites may require you to correct, add a disclosure to, or remove any promotion that we reasonably believe is inaccurate, misleading, unlawful, outdated, or inconsistent with these terms.

Failure to comply promptly may result in suspension or termination.

14. PROHIBITED PROMOTIONAL METHODS

You are solely responsible for ensuring that your promotional communications comply with all applicable email, telephone, text-message, privacy, advertising, consumer-protection, and platform rules.

You may not use:

  • spam or unsolicited bulk email;
  • purchased, harvested, or unlawfully obtained contact lists;
  • commercial email that lacks required sender information, disclosures, a valid postal address, or a working unsubscribe method;
  • text messages, automated calls, prerecorded calls, or robocalls without legally sufficient consent;
  • repeated contact after a person asks you to stop;
  • cookie stuffing;
  • hidden links or iframes;
  • forced redirects;
  • fake accounts or purchases;
  • false coupons or discounts;
  • misleading advertisements;
  • impersonation;
  • fake reviews;
  • fraudulent traffic;
  • bots;
  • malware;
  • phishing;
  • deceptive earnings claims;
  • or unlawful content.

You must promptly honor unsubscribe, opt-out, and do-not-contact requests.

Freak Sites may require evidence that recipients consented to affiliate promotional communications.

PAID ADVERTISING IS ALLOWED

Unlike many affiliate programs, Freak Sites allows affiliates to use lawful paid advertising.

Affiliates may use:

  • search-engine advertising;
  • social-media advertising;
  • display advertising;
  • sponsored content;
  • promoted posts;
  • and other lawful paid traffic sources.

Affiliates may use their own money to advertise:

  • Freak Sites;
  • an individual Island;
  • Island products or services;
  • their affiliate links;
  • approved landing pages;
  • and approved promotional content.

Paid advertisements must:

  • be truthful and not misleading;
  • clearly identify the affiliate relationship where required;
  • comply with the advertising platform’s rules;
  • direct users to an accurate and functional landing page;
  • avoid false pricing, discounts, earnings claims, or guarantees;
  • and make clear that the affiliate is an independent promoter rather than Freak Sites itself.

Affiliates may bid on Freak Sites and Island-related keywords, including branded search terms, provided the advertisement does not impersonate Freak Sites, falsely claim to be the official website, or create confusion about who is placing the advertisement.

Affiliates may not:

  • use “official” or similar language in a misleading way;
  • represent that an affiliate-owned page is operated by Freak Sites;
  • use a display URL that deceptively appears to be a Freak Sites-owned domain;
  • copy official advertisements in a manner that creates confusion;
  • use deceptive redirects or hidden tracking;
  • or violate trademark, advertising, or consumer-protection laws.

Each affiliate is responsible for all advertising costs, platform fees, campaign decisions, targeting, landing pages, and compliance associated with paid advertising.

APPROVED ADVERTISING MATERIALS

Freak Sites or an individual Island may provide affiliates with approved:

  • advertisements;
  • banners;
  • images;
  • videos;
  • written copy;
  • landing pages;
  • links;
  • and other promotional materials.

Affiliates may use these materials for lawful promotion, subject to any instructions provided with them.

Affiliates may also create their own paid advertisements and promotional materials.

An affiliate may submit independently created advertising to Freak Sites or the applicable Island for review before publication.

Approval is not required unless Freak Sites specifically states otherwise, but affiliates remain responsible for ensuring that all advertising:

  • is truthful and not misleading;
  • contains required affiliate disclosures;
  • does not promise income or guaranteed results;
  • does not impersonate Freak Sites or an Island;
  • complies with advertising-platform rules;
  • and complies with applicable law.

Freak Sites’ review or approval does not transfer responsibility for the affiliate’s campaign, targeting, advertising costs, platform compliance, or later modifications.

Any material changed after approval may be treated as unapproved if the change affects the meaning, claims, disclosures, pricing, or presentation.

15. CUSTOMER AND PROGRAM INFORMATION

Customer and affiliate information must be used only for legitimate Affiliate Program purposes.

You may not:

  • scrape customer information;
  • build unauthorized marketing lists;
  • disclose private transaction information;
  • contact customers without lawful permission;
  • sell customer information;
  • or use program data for unrelated purposes.

Affiliates do not own customers or acquire ownership rights in customer information.

Information is handled according to the Freak Sites Privacy Policy.

16. SUSPENSION AND TERMINATION

You may stop participating in an Island Affiliate Program at any time.

Leaving one Island Affiliate Program does not automatically terminate your participation in another Island Affiliate Program.

Freak Sites may suspend or terminate an affiliate account on one or more Islands for reasons including:

  • fraud;
  • spam;
  • cookie stuffing;
  • tracking manipulation;
  • misleading claims;
  • undisclosed affiliate promotion;
  • brand misuse;
  • duplicate accounts;
  • unlawful conduct;
  • or violation of these terms.

During an investigation, Freak Sites may place commissions or payouts on hold.

After termination from an Island Affiliate Program:

  • you must stop presenting yourself as an affiliate of that Island;
  • permission to use that Island’s branding ends;
  • affiliate links may stop tracking;
  • linked customers may stop generating future commissions;
  • and pending commissions remain subject to review.

If termination is unrelated to misconduct, approved commissions earned before termination may remain payable.

Commissions connected to fraud, deception, manipulation, or a material violation may be rejected or forfeited where permitted by law.

17. PROGRAM CHANGES

Freak Sites or an individual Island may change:

  • commission rates;
  • paid tiers;
  • eligible products;
  • prices;
  • tracking rules;
  • cookie duration;
  • customer-linking rules;
  • payout schedules;
  • payout methods;
  • and other Affiliate Program terms.

Changes generally apply prospectively.

An Island Affiliate Program is not guaranteed to continue forever or remain in its current form.

Continued participation after updated terms become effective constitutes acceptance where permitted by law.

18. DISCLAIMER AND LIMITATION OF LIABILITY

Each Island Affiliate Program is provided on an:

“AS IS” AND “AS AVAILABLE”

basis.

Freak Sites does not guarantee:

  • uninterrupted website operation;
  • error-free tracking;
  • successful customer linking;
  • referrals;
  • purchases;
  • commissions;
  • affiliate-network growth;
  • payment timing;
  • advertising results;
  • or income.

To the fullest extent permitted by law, Freak Sites is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost:

  • commissions;
  • profits;
  • opportunities;
  • traffic;
  • customers;
  • advertising expenses;
  • or data.

Freak Sites’ total liability arising from an Island Affiliate Program will not exceed the amount of approved commissions paid or payable to you through that Island during the twelve months immediately before the event giving rise to the claim.

Nothing in these terms excludes liability that cannot lawfully be excluded.

19. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Freak Sites, Inc. and its officers, directors, employees, contractors, affiliates, and service providers from claims, losses, liabilities, costs, and reasonable legal fees arising from:

  • your promotional activity;
  • your paid advertising campaigns;
  • your advertising or earnings claims;
  • your failure to disclose your affiliate relationship;
  • your email, telephone, or text-message activity;
  • your violation of law;
  • your misuse of customer information;
  • your infringement of another person’s rights;
  • or your breach of these terms.

20. GOVERNING LAW

These terms are governed by the laws of the State of New Mexico. Unless applicable law requires otherwise, legal proceedings will be brought in a court of competent jurisdiction serving Doña Ana County, New Mexico. The parties agree to attempt in good faith to resolve disputes informally before filing litigation.

21. RELATED POLICIES

These Affiliate Terms incorporate, where applicable:

  • the Freak Sites Terms and Conditions;
  • the Freak Sites Privacy Policy;
  • Advertising Terms;
  • Advertising Refund Policy;
  • Prohibited Ads Policy;
  • Copyright Complaints procedures;
  • Legal & Earnings Disclosure;
  • the current commission information published by the applicable Island;
  • and any Island-specific rules or notices.

If another policy conflicts with these terms on an affiliate matter, these Affiliate Terms control unless a specific written Island term clearly states otherwise.

22. GENERAL TERMS

You may not transfer your affiliate account, linked customers, commissions, referral links, or affiliate position without written permission.

If part of these terms is unenforceable, the remaining provisions remain effective.
Failure to enforce a provision does not waive the right to enforce it later.
Section headings and bold print are provided for convenience only and do not limit, expand, or otherwise alter the meaning of these terms.

These terms and the incorporated policies constitute the complete agreement concerning participation in an Island Affiliate Program.

23. ELECTRONIC ACCEPTANCE

Submitting an affiliate application, accepting these terms electronically, accessing an Affiliate Dashboard, using an affiliate link, or continuing to participate constitutes your electronic acceptance.

Your enrollment in one Island Affiliate Program does not enroll you in another Island Affiliate Program.

THE SIMPLE VERSION

Each Freak Sites Island has its own separate Affiliate Program.

  • Joining one Island does not enroll you in another.
  • You must apply separately on each Island you want to promote.
  • Joining is free.
  • You do not have to purchase a listing or advertisement.
  • Use the correct affiliate link for the correct Island.
  • Tell people that you may earn a commission.
  • Promote the Island honestly.
  • Paid advertising is allowed.
  • Do not promise income.
  • Do not spam people.
  • Do not impersonate Freak Sites or an Island.
  • Do not manipulate tracking.

When a customer is successfully linked to you on an Island, you may continue earning commissions on that customer’s future qualifying purchases on that Island.

If you believe a qualifying customer or purchase was not credited properly, contact us and provide evidence so we can review it.
